1. Acceptance of Terms

By accessing or using Simply Garden ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Simply Garden provides personalized garden planting calendars based on USDA hardiness zone data. The Service includes free and paid tiers with varying features as described on our pricing page.

3. Accounts

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating an account. You must be at least 13 years old to use the Service.

4. Paid Plans & Billing

• Subscription plans are billed monthly or annually as selected at purchase.
• Annual plans auto-renew unless cancelled at least 24 hours before the renewal date.
• One-time purchases (Weekend Warrior) are non-recurring and do not expire.
• We will notify you by email 7 days before any subscription renewal.

5. Refunds

Monthly subscriptions may be cancelled at any time. We offer a full refund within 14 days of your first payment for any plan. After 14 days, remaining subscription time will not be refunded, but you will retain access until the end of your billing period.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, scrape, or resell the Service or its data.
• Share account credentials with others or create multiple free accounts.
• Upload harmful content to community features.

7. Gardening Disclaimer

Simply Garden provides planting recommendations based on USDA zone data and general crop guidelines. Results may vary based on microclimates, soil conditions, weather events, and other local factors. We do not guarantee specific harvests or outcomes. Always use your best judgment and consult local extension services for region-specific advice.

8. Intellectual Property

The Service, including its design, features, and content, is owned by Simply Garden. Your garden data and uploaded content remain yours. By using community features, you grant us a license to display your shared content within the Service.

9. Termination

We may suspend or terminate accounts that violate these terms. You may delete your account at any time from your account settings. Upon deletion, your data will be permanently removed within 30 days.

10. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
